Council Gives Final Approval to RESALE Act, Regulating Ticket Sales and Capping Ticket Resale Prices

In a significant move to protect consumers in Washington, D.C., the City Council has given final approval to the Restricting Egregious Scalping Against Live Entertainment (RESALE) Act. During its recent Legislative Meeting, the Council unanimously passed the bill, aimed at regulating the secondary ticket market and addressing concerns over excessive resale prices for live entertainment events, such as concerts and theatrical performances.

The RESALE Act introduces a price cap on secondary ticket sales, limiting the maximum resale price to 120 percent of the original ticket value, including fees. This cap applies equally to both for-profit resellers and private individuals, ensuring that all consumers benefit from the new regulations. Notably, the legislation excludes tickets for sporting events and movies, focusing solely on live entertainment.

To adapt to potential market changes, the Act empowers the mayor to adjust the price cap one year after implementation, allowing for flexibility between zero to twenty percent above the face value of tickets. Additionally, the bill addresses common grievances of ticket purchasers by banning speculative pricing and requiring that advertised ticket prices include all associated fees upfront. This measure aims to eliminate the surprises that often accompany ticket purchases.

Another significant provision of the RESALE Act is the prohibition of “surveillance pricing,” which leverages consumers’ personal data to increase ticket prices. However, the bill allows for demographic-based pricing discounts for groups such as seniors and veterans. Furthermore, any individual or corporation reselling more than fifty tickets annually will need to register and obtain a license from the District’s Department of Licensing and Consumer Protection (DLCP), enhancing oversight in the ticket resale market.

The RESALE Act reflects the Council’s commitment to consumer protection and fair pricing in Washington, D.C., particularly in neighborhoods known for their vibrant cultural scenes. As the city continues to host a wide array of live events, the successful implementation of this legislation will be closely monitored to ensure it meets its intended goals of fairness and transparency in ticket sales.
