Daveion Antonio Ervin, a 28-year-old man with a prior felony conviction, has been sentenced to 27 months in prison for illegal firearm possession, according to the U.S. Attorney’s Office for the District of Columbia. The sentence was handed down in U.S. District Court after Ervin pleaded guilty to one count of being a felon in possession of a firearm and ammunition.
U.S. District Court Judge Carl J. Nichols also ordered Ervin to serve three years of supervised release following his prison term. Federal prosecutors had initially sought a 33-month sentence, highlighting the seriousness of the offense.
The incident that led to Ervin’s arrest occurred on February 18, 2026, when U.S. Park Police officers, patrolling the area of Dix Street and 63rd Street NE, noticed Ervin smoking what appeared to be marijuana. Upon attempting to stop him, Ervin fled the scene, discarding the cigarette as he ran. Following a brief pursuit, officers apprehended him after he tripped and fell, during which he admitted to possessing a firearm without a license.
Police recovered a loaded Springfield Armory XDS-9 9mm pistol from Ervin’s waistband, along with the remnants of the marijuana cigarette along his escape route. The case was part of the Make D.C. Safe and Beautiful initiative, which aims to address gun violence and enforce stricter penalties for federal firearms violations.
Chief Scott Brecht of the U.S. Park Police joined in the announcement of the sentencing, emphasizing the collaborative efforts to combat illegal firearms in the community. The investigation was conducted by the U.S. Park Police, with prosecution led by Assistant U.S. Attorney Emory V. Cole.
